Terms of use

Last updated:

These terms apply to the Evenfade app on iPhone and Android. Evenfade is published by Sullivan Floricourt, sole trader, trading as Kotchi Studio in France (“we”). Evenfade is intended for adults, aged 18 and over. By using the app, you accept these terms.

The app

Evenfade is a place to write what weighs on you and let it go. You write, press Release, and the words disappear into a night scene. There is no account, and nothing you write is kept: see our privacy policy.

Evenfade is free to download and use, with one scene, free writing and some of the questions and letters.

Evenfade Premium

Evenfade Premium is a one-time purchase, not a subscription. It unlocks every scene in the app, the scenes we add to Evenfade later, and all the questions and letters, for as long as we offer Evenfade. There is nothing to renew and nothing is charged again.

  • Payment goes through the App Store (Apple) or Google Play (Google), under their terms. The price is the one shown in the store before you confirm, taxes included where they apply.
  • Restore purchases, on the Premium screen, brings Premium back after a reinstall or on a new phone using the same Apple or Google account. On iPhone, Premium can be shared with your Family Sharing group.
  • Refunds are handled by Apple and Google, under their own policies: request one from the App Store or Google Play. We cannot issue refunds ourselves, since we never receive your payment details.
  • Right of withdrawal (EU and UK). Premium is digital content delivered immediately. By confirming the purchase, you ask for it to be delivered at once and acknowledge that you then lose the 14-day right of withdrawal, as the law allows. Apple’s and Google’s refund policies still apply.

Your licence

We grant you a personal, non-exclusive, non-transferable licence to use Evenfade on the devices linked to your Apple or Google account, for your own private, non-commercial use. On iPhone, Apple’s Licensed Application End User License Agreement also applies.

You may not copy, resell, modify or reverse-engineer the app, its scenes, sounds or texts, except where the law expressly allows it.

What you write

What you write is yours. It stays on your screen, is never saved and never sent to us, so we cannot read it, recover it or restore it. Once released, it is gone for good.

Not a medical or crisis service

Evenfade is not therapy, not a medical device and not a crisis service. It does not diagnose, treat or prevent any condition, and it is no substitute for help from a doctor, a therapist or someone you trust.

If you are in danger or thinking about hurting yourself, call your local emergency number now. The Need to talk? page, in the app and on this site, lists free helplines.

Availability and changes

We work to keep Evenfade running smoothly, but we cannot promise it will always be free of errors or available on every device. We may update the app, change or add scenes, questions and features. We will not remove a feature you paid for without a good reason, such as a legal requirement or a technical change by Apple or Google.

Liability

Nothing in these terms limits your rights as a consumer under the law of the country where you live, including the legal guarantee of conformity for digital content. Within those limits, Evenfade is provided as it is, and we are not liable for indirect losses, or for losses caused by events beyond our reasonable control.

Disputes and applicable law

These terms are governed by French law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live.

If something goes wrong, write to us first: most problems are solved quickly that way. If we cannot agree, you may turn to a consumer mediation service or to the competent courts.

Changes to these terms

If these terms change, we will update this page and the date at the top. Changes never take away a purchase you have already made.
